A special meeting of the Circle Executive Committee of AICEIA, Chandigarh Circle, was held on 4.02.2012 at the Conference Hall, Central Revenue Building, Plot No. 19, Sector 17-C, Chandigarh which was attended by the following members:

“MINUTES OF THE MEETING”

At the outset, Shri Manoj Nayyar, President, AICEIA, Chandigarh Circle, Chandigarh, welcomed the participants and handed over the proceedings of the Circle Executive Committee to the General Secretary. The following points were discussed in detail and the resolutions adopted are appended as below:

Point No. 1 : Holding of Organization election of AICEIA, Chandigarh Circle as per the present constitution of the AICEIA:

The President appraised the house that as decided in CEC Meeting held on 21/01/2012 he alongwith Sh. Malkit Singh and Sh. Mukesh Anand attended the National CEC Meeting of the AICEIA at Hyderabad on 27th and 28th January, 2012. He further informed that there was a proposed amendment in the Constitution to follow the Delegate System for electing Circle/Branch Units of the Association and it was noticed that about 90% of the participating units (circles) have been following the delegate system and that the Constitutional amendment was approved. In view of the above, this Circle unit has to do away with the system of Direct Franchise (proposed to be completed by 28.02.2012) and proposes to hold the elections to the Circle/Branch Units on the basis of delegate based system as is being followed at All India Level in accordance with the procedure laid down in Article 20 of the Constitution of AICEIA. The President then requested Sh. Malkit Singh to enlighten the house about details of the proposed delegate system.

Shri Malkit Singh, All India Vice President of AICEIA, explained the procedure mentioned in the Constitution of AICEIA, which is being followed for the election of the all India office bearers of AICEIA and most of the Circles associations of AICEIA. It was brought to the notice of the house that the Secretary General of AICEIA vide letter AICEIA/ORG/56/2012 dated 31/1/2012 has given clarification for holding the election for the office bearers of AICEIA, Chandigarh Circle in accordance with the procedure laid down in the constitution. Accordingly, it was decided to first hold the Unit level election in the Chandigarh AICEIA, Circle on 01.03.2012 to elect the delegates. These delegates will meet in a convention to be held at Chandigarh on 11.03.2012 to elect the office bearers of AICEIA, Chandigarh Circle. Then the house discussed the formations of units in the jurisdiction of the Circle, which will be represented by a delegate in the convention. It was decided that a total of 33 delegates shall be elected from the jurisdiction of AICEIA, Chandigarh Circle. Total strength of 33 delegates to be elected from the various units of the AICEIA, Chandigarh Circle has been arrived at as per the procedure laid down in Article 13 of the AICEIA constitution. It was also resolved that the delegates will elect the office bearers in the convention in accordance with Article 13 of the constitution. The jurisdiction of AICEIA Chandigarh, Circle comprises of five Central Excise/Customs Commissionerate and each Commissionerate shall have the following number of units and the number of delegates who would be elected by these units:

It was also decided that in case there is no nomination from a particular unit, the present Branch Secretary will nominate the delegate who will represent that particular branch in the convention. The above resolution was passed unanimously by the House.

Point No. 2. Extension of time period for new Membership Drive as desired by the House:

It was informed by Shri Bhagwan Singh, Branch secretary, Ludhiana and Shri R.C.Sharma, Branch secretary, Amritsar that due to various reasons, number of colleagues who want to become the member of the association, could not submit their membership form by due date. Since, the earlier notifications issued for holding the election has since been withdrawn and fresh dates for holding the election has been announced in accordance with the procedure laid down in Article 20 of the AICEIA constitution, it has been approved by the house that another chance may be given to our colleagues to become member of the association. Thus, it has been decided that forms for new membership shall now be accepted till 10.02.2012. All the Branch Secretary have been requested to do the needful in this regard and hand over such forms complete in all respect to the President/ General Secretary by 11.02.2012, positively.

Point No. 3. To discuss non-acceptance of membership of Shri C.S.Sandhu, Inspector (erstwhile Branch secretary of the Ludhina Branch ) and Shri Sunil Bansal,, inspector (erstwhile Vice president of the AICEIA, Chandigarh Circle):

All the members present in the meeting were of the view that both the aforesaid erstwhile office bearers of the AICEIA, Chandigarh Circle namely Shri C.S Sandhu and Shri Sunil Bansal have resigned from the association due to their malafide intentions and even after resignation continued to indulged in anti cadre activities. Thus, it has been resolved that no purpose would be served at this juncture by deciding on their request for membership of the association and as such, matter has been left for the consideration of the new office bearers of the AICEIA, Chandigarh Circle, who may decide whether to accept or reject the membership forms of both Shri C.S.Sandhu, and Shri Sunil Bansal, at an appropriate juncture.

Point NO. 4. Resignation of Shri Manish Kumar, Inspector from the post of Returning Officer and appointment of new Returning Officer for conducting the forthcoming election of the AICEIA, Chandigarh Circle:

The house also discussed the situation arising out of the sudden resignation of Shri Manish Kumar, Inspector from the post of Returning officer during the course of the meeting and the same was accepted on his persistent request. The house then resolved to appoint Shri Malkit Singh, All India Vice President (North Zone) of AICEIA, as the new Returning Officer for holding the forthcoming election of the AICEIA, Chandigarh Circle. The returning officer will have the responsibility of holding/overseeing the election of the delegates of the all the units of AICEIA, Chandigarh Circle and election of the office bearers of the Association in the convention.

The meeting ended with a vote of thanks to the Chair and the House directed the general secretary to record the Minutes of Meeting.

This issues with the approval of the President, AICEIA, Chandigarh Circle, Chandiagrh.
