COMMUNICATIONS WITH THE ADMN.

THE FOLLOWING IMPORTANT COMMUNICATIONS HAVE BEEN ADDRESSED TO THE ZONAL ADMINISTRATION BY THE ASSOCIATION. THESE ARE BEING REPRODUCED FOR INFORMATION OF THE MEMBERS. SOME IMPORTANT MATTERS ARE REQUIRED TO BE TAKEN UP WITH THE ADMN, CORRESPONDENCE ABOUT WHICH WILL BE ISSUED AND PUT ON THIS SITE SHORTLY.

Subject : -Grant of  grade pay of Rs. 5400/- to the Inspectors on   completion of four years of service in the G. P. of 4800/-.

Your kind attention is drawn to Association letters dated 09/12/2012 and 24.12.29012,  on the above cited subject. In this regard,  it is submitted that no meeting of the DPC Committee has so far been fixed as per the information available with the Association despite the assurance on the part of your goodself that the MACP will be granted to the eligible officers by 31.112.2012. It is needless to remind that the exercise regarding the grant of MACP to the officers who were due to get the benefit before 31.03.2013, was required to be completed by 30.09.2012 as per the DOPT guidelines on the subject. No doubt, the benefit of MACP will be granted and available to the eligible officers w.e.f. 01.01.2013, but it would be much better if they are able to get their benefit alongwith their salary for the month of January, 2013 because to the officers suffering from unimaginable and intolerable stagnation for more than two decades, this non-functional financial benefit is merely a solace. Whatever we have gathered from our constituent members is that the matter is being taken as a routine, which should not be the case as the deadline for completion of this exercise which had already elapsed on 30.09.2012.

In view of the above, it is requested that the necessary directions may be issued to the Commissioner ( Cadre Controlling), Chandigarh for taking immediate steps in this direction so that the MACP is granted to the eligible officers immediately. We are also under pressure from our constituents to take some direct action if the fruitful results are not coming despite the repeated representations of the Association. We are sorry to inform your goodself that the Association will be compelled to go in for “sit-in-demonstration ( Dharna )” at Hqrs. Office at Chandigarh if the needful is not done expeditiously as the patience of our members is being wiped out in view of the various problems being faced by our cadre in terms of career progression and other related matters and there is growing sense of injustice being done to our cadre.

Subject : -Request for appointment  to discuss the cadre welfare
issues.  

 Revered Sir,

It is requested that the association may be given an appointment to see your goodself on any working day. We wish to discuss some important issues relating to the welfare of the cadre, which inter-alia include the followings : -

1.  Filling up of the existing vacancies of Superintendents lying vacant on account of the non-availability of suitable/eligible ST candidates.
2.  The grant of MACP benefit to the eligible officers, which has already been delayed as the exercise was required to be completed by 30.09.2012.
3.  The holding of DPC and issuance the confirmation orders of the Inspectors, who have already successfully completed their probation period and fulfilled other conditionalities/qualifications.
4.  The timely holding of the DPC for the next vacancy year 2013-14, an exercise that is required to be completed by 30.03.2013.
5.  The issues related to the payment of outstanding bills on account of TA/Medical/tuition fees etc.
6.  The issues related to the provision of residential accommodation to the officers of our cadre as per their entitlement.
7.  The issues related to the provision of sitting space in the offices as per their entitlement by hiring new buildings for the offices which can be shifted out of the main headquarters building ( C.R. building).
8.  Provision of adequate guest house and transit facilities at different stations in the Zonal jurisdiction.
9.  The provision of mobile sets & connections, laptops, brief-cases, petrol reimbursement and other facilities out of the special revenue-incremental grants received from the govt.
10.                      Regarding the sanction of additional posts of Superintendents and Inspectors in view of the increased workload and the follow up taken and required to be taken up in this regard with the Board authorities so that these posts are expeditiously sanctioned.
11.                      Regarding the filling up of the posts of Inspectors, which are lying vacant ( more than 100 ) against the sanctioned strength of the zone.
12. Regarding the creation of one more Central Excise Division in Jammu and Kashmir Commissionerate, proposal for which was mooted in 2008 by the Department.

Subject: - Promotions to the grade of Superintendents against unfilled ST      vacancies on account of non-availability of suitable/qualifiable ST candidates.         

 Hon’ble Sir,
               
                Your kind attention is drawn to the Minutes of the meeting of Circle Executive Committee of Association held at Jammu on 13.08.2012 and  subsequent correspondence by the Association on the subject, followed by subsequent discussions with your good-self in your office at Chandigarh held on 09.10.2012. It is once again requested that  posts of Superintendents  lying unfulfilled on account of the non-availability of suitable candidates of the ST category in the Zone in view of the fact  that the next candidate of ST category will attain the qualification of minimum eight years of service in the grade of Inspector for promotion to the grade of Superintendent in the year 2017. 
   
As per the instructions contained in OM No. 36011/25/79-Estt (SCT) dated 16.11.1979, the posts lying vacant on account of the non-availability of suitable candidates of reserved category may be dereserved and fulfilled by the Department itself as per the procedure laid down in this Circular. Further, as per OM No. 36011/5/81-Estt. (SCT) dated 07.04.1981, the department should only wait for a period of two weeks after sending the requisite proposal to the DOPT and Commissioner for STs for their comments. In view of the above, it is crystal clear that the posts lying vacant can be filled expeditiously if the proposal is sent to the concerned authorities. In the instant case, these posts are lying vacant due to the non-availability of suitable candidates and moreoever, no candidate of this category is available for being promoted till 2017 as none of them will be completing their qualifying service of 8 years as Inspector before 2017. Further, these posts cannot be carried forward beyond a period of three years and automatically lapse and become available to the suitable candidates from other categories after elapse of that period of three years. Hence, in all circumstances, there will be no loss to any candidate of ST category if these posts are filled in from suitable candidates of other categories.

 Your goodself is already aware that there is acute stagnation in the cadre of Inspectors as the Inspectors of 1993 batch are still awaiting their promotion.  The Association is of the view that the instructions of Govt ( DOPT OMs) are being selectively used. These instructions, when interpreted in proper perspective, clearly lay down that the posts reserved for reserved candidates may be filled immediately from the general candidates in case of non–availability of the suitable candidate of reserve category and the equivalent number of posts need to be carried forward in the next recruitment year for being filled from reserved candidates on priority. In case of non-availability of the such candidates in the next recruitment year, these posts can be further carried forward to the second next year and so on. Therefore, there appears to be no mandate through these instructions that these posts be kept unfulfilled due to non-availability of the suitable reserved candidates, which is being done by our Department in the instant case due to the non-availability of the suitable ST Candidates.

                In view of the above submissions, it is requested that the unfilled vacancies of the ST category may be filled immediately by promotion from the suitable available candidates.

                Since the matter is of immense significance to the Inspector cadre, an early action in the matter is highly solicited. Further, as the meeting with your goodself could not be held on 27th as requested vide Association’s letter dated 24.12.2012 due to communication gap/non-communication, it is again requested that we may also be granted a personal hearing to present this issue before your goodself.

This letter is being issued with the prior approval of the President.
